ProPal SMS Terms and Consent Disclosures

These SMS Terms and Consent Disclosures (the “SMS Terms”) govern text and multimedia messages sent through ProPal. They supplement the Terms of Use and Privacy Policy. If these SMS Terms conflict with the general Terms on a messaging-specific issue, these SMS Terms control.
1. Program Name and Operator
The messaging program is operated under the name ProPal by EMOTION Software Development, LLC, 1615 Southern Hills Dr., Ardmore, Oklahoma 73401.
Customer support is available by text at (580) 217-3213 or by email at hello@textpropal.com. Service-provider support is available through the ProPal provider application dashboard.
2. Program Purpose
ProPal provides conversational SMS and MMS intake and coordination for residential and property-related home-service requests within the United States. Messages may be used to:
- acknowledge and respond to a customer-initiated request;
- ask for the service type, address, timing, photographs, or clarifying details;
- identify and classify the likely home-service category;
- communicate that ProPal is checking provider eligibility or availability;
- notify a customer that a request was sent, accepted, declined, timed out, rerouted, or could not be matched;
- introduce a customer to an independent provider;
- transmit limited provider questions or responses before handoff;
- confirm a handoff, completion status, review, rating, or support event;
- provide account, security, billing, or operational notices to providers; and
- respond to HELP, STOP, START, UNSTOP, or similar carrier-recognized commands.
ProPal does not use the customer service-request program to send unrelated third-party advertising or to sell mobile consent to providers, affiliates, or lead generators.
3. How Consent Is Obtained
3.1 Customer-Initiated Text
A customer may initiate a conversation by texting a ProPal-controlled number displayed on the ProPal website, saved through a ProPal contact card, provided by a participating provider, printed on provider materials, embedded in a QR code or text link, or shared by another customer. By sending the first message, the customer requests a response and consents to receive conversational and service-related messages concerning that request.
The disclosure displayed near a public number, QR code, vCard, or text link should state substantially:

3.2 Web or Application Consent
If ProPal later collects a number through a website or application form for outbound messaging, the messaging consent must be separate, clear, unambiguous, optional unless messaging is strictly necessary for the requested transaction, and not prechecked. The user must be able to decline recurring messaging without being forced to accept unrelated terms or marketing.
3.3 Provider Messaging Consent
Providers consent to operational SMS, email, and in-application communications as part of account onboarding, subscription management, dispatch, security, billing, and support. Marketing consent, if any, must be separately described where required.
3.4 Proof of Consent
ProPal may retain evidence of consent, including the source number, destination number, timestamp, initial message, form version, disclosure version, IP address, user agent, keyword, campaign, and opt-out history. Such records may be provided to carriers, Twilio, regulators, courts, or other parties when reasonably necessary to demonstrate compliance.
4. Message Frequency
Message frequency varies. A customer may receive multiple messages during an active request because the Service is conversational and depends on clarification, routing, provider response, and status changes. A customer with no active request ordinarily should not receive recurring service messages except legally permitted support, security, opt-out confirmation, or previously requested follow-up.
ProPal does not promise a fixed monthly message count. The number of messages depends on customer replies and the number and complexity of active requests.
5. Charges and Carrier Responsibility
Message and data rates may apply according to the customer’s mobile plan. ProPal does not charge a customer a separate fee merely to send or receive standard Service messages, but the customer’s carrier may impose charges.
Wireless carriers are not liable for delayed or undelivered messages. Delivery may fail because of filtering, handset settings, number reassignment, network congestion, outages, roaming, account restrictions, unsupported content, or other carrier conditions.
6. Opt-Out
A recipient may opt out at any time by replying STOP. Carrier and Twilio systems may also recognize keywords such as STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. ProPal will honor valid opt-out requests as required by law and carrier policy.
After opt-out, the recipient may receive a final confirmation message substantially similar to:
ProPal: You have been unsubscribed and will receive no further ProPal text messages from this number. Reply START to resume. For help, email hello@textpropal.com.
Opting out may prevent ProPal from continuing an active request by SMS. It does not cancel or modify a separate contract with an independent provider. The customer may communicate directly with a provider using contact information exchanged during the handoff.
An opt-out applies to the relevant ProPal messaging sender or program as required by applicable law and carrier implementation. ProPal may retain a suppression record to prevent future messaging.
7. Re-Opt-In
Where supported, a recipient may reply START or UNSTOP to resume messages. A re-opt-in confirmation may state:

A new customer-initiated request after opt-out does not automatically override a carrier-level suppression if the carrier or Twilio requires an express re-opt-in keyword.
8. Help
Reply HELP for help. A response may state:

For emergency conditions, do not use HELP or wait for a ProPal response. Call 911 or the appropriate emergency or utility authority.
9. Sender Identification
Messages should identify ProPal in the initial response and at reasonable intervals. A participating provider may be named in the conversation, but ProPal is the sender of the automated intake and routing messages unless the message clearly states otherwise.
Sample initial message:
ProPal: Thanks for reaching out. I can help connect you with a local home-service professional. What service do you need and what is the service address? Message frequency varies. Reply STOP to opt out.
Sample routing message:
ProPal: I sent your [service type] request to [Provider Name]. I’ll text you here when they respond. Reply STOP to opt out.
Sample handoff message:
ProPal: [Provider Name] accepted your request. I’m introducing you now so you can discuss inspection, scheduling, scope, and price directly. Reply STOP to opt out of ProPal messages.
10. Assigned Numbers and Provider Attribution
A participating provider may distribute a dedicated ProPal-controlled Twilio number. Every assigned number remains owned and controlled by ProPal. Texts to the number enter the common ProPal system.
The destination number may preserve attribution to the provider that distributed it. Attribution can continue when a customer shares the number with another person. Attribution does not mean the provider owns the customer, owns the number, controls consent, or is guaranteed every request.
When the source provider is active, eligible, available, qualified for the service, and within coverage, ProPal may give that provider first consideration. Otherwise, ProPal may route the request to another eligible provider.
If a provider cancels, the number remains with ProPal. ProPal may continue responding to customers who have saved, received, used, or shared that number and may route their requests through the wider ProPal network.
11. Transactional and Conversational Nature
The program is primarily customer-initiated and service-related. Messages concern intake, routing, provider coordination, handoff, completion, ratings, support, and related operational communications.
ProPal will not convert service-request consent into consent for unrelated advertising. If ProPal introduces a separate promotional campaign, it will obtain and document the consent required for that campaign and provide campaign-specific disclosures.
12. Mobile Information Privacy
No mobile information, SMS opt-in data, or messaging consent will be sold or shared with third parties or affiliates for their own marketing or promotional purposes.
ProPal may disclose service-request information, including a customer’s name, phone number, service address, request details, and photographs, to an eligible provider when necessary to evaluate, accept, schedule, quote, perform, or support the customer-requested service. This operational disclosure is not a transfer of SMS consent and does not authorize the provider to add the customer to an unrelated marketing list.
ProPal also uses communication and infrastructure processors, including Twilio, SendGrid, Supabase, OpenAI and/or Anthropic, Google Maps Platform, Stripe, and supporting vendors, as described in the Privacy Policy.
13. Number Reassignment and Shared Devices
You must notify ProPal or opt out before giving up a mobile number used with the Service. If a number is reassigned, the new subscriber may receive messages intended for the prior user until ProPal or the carrier learns of the change.
Do not use a shared device or family number to submit sensitive details unless you understand that other authorized users of the device may view the conversation.
14. Content and Conduct
You may not use ProPal messaging to send:
- threats, harassment, hate, unlawful discrimination, obscenity, or exploitation;
- fraudulent service requests or impersonation;
- malware, phishing links, credential requests, or harmful files;
- unsolicited advertising, purchased lists, or marketing without consent;
- illegal goods, regulated activities outside ProPal’s supported use case, or instructions to evade law;
- Social Security numbers, full payment-card data, account credentials, or unnecessary highly sensitive data; or
- content that infringes intellectual-property, privacy, publicity, or confidentiality rights.
ProPal may block, filter, suspend, preserve, or report messages that violate law, carrier rules, Twilio policy, these SMS Terms, or the Acceptable Use Policy.
15. AI-Assisted Messages
Messages may be interpreted or generated using custom AI workflows and model providers such as OpenAI and/or Anthropic. AI responses can be inaccurate and are not professional advice, diagnosis, estimates, quotes, emergency instructions, or guarantees.
Routing may also rely on deterministic rules involving service type, location, coverage, provider status, availability, attribution, and response history. The use of AI does not remove the customer’s obligation to confirm important information with the independent provider.
16. Service Interruptions
ProPal does not guarantee continuous messaging. Twilio, carriers, Supabase, AI providers, internet providers, device systems, or other vendors may experience outages or filtering. ProPal may pause messages for security, compliance, abuse prevention, maintenance, or legal reasons.
A failure to receive a message does not establish that a provider accepted, declined, scheduled, or completed a request. Customers should confirm critical arrangements directly with the provider after handoff.
17. Emergency Exclusion
ProPal messaging is not an emergency service. Do not use ProPal for immediate threats to life, health, safety, or property. Call 911 or the appropriate utility, fire department, police department, poison-control center, or emergency authority.
18. Changes
ProPal may update these SMS Terms to reflect changes in law, carrier requirements, Twilio policies, program operation, or product features. The current version will be posted at `textpropal.com/sms-terms` with an effective date.
